I represent business in labor & employment matters, including:

  • FLSA compliance;
  • Development of pay practices and policies;
  • Proper classification of independent contractors and employees;
  • Proper classification of employees as exempt or non-exempt;
  • Defense of class-action, collective-action and single-plaintiff lawsuits;
  • Development of enforceable mediation and arbitration programs;
  • Defense of administrative claims before the NLRB, DOL, and EEOC;
  • Arbitration claims;
  • Analysis and enforcement of non-compete agreements, non-solicitation agreements, and confidentiality agreements;
  • Traditional labor matters, including unfair labor practices claims; and
  • Union avoidance, planning, and strategy.

I also focus on privacy law, internet forensics, and business litigation. I have successfully represented businesses and individuals in lawsuits involving wrongdoing over the Internet, including defamation, computer hacking, identity theft, and theft of confidential business information.
